“BNK-Ukraine” has stopped jet fuel supplies to Ukraine because of the conflict with custom

According to sources in the market, the Belarusian oil trader since December of last year worsened relations with the Ukrainian customs, and they may have a corruption soil.

As previously reported, “the Diary”, in January this year, “BNK-Ukraine”, which was in 2015, the largest aviation-fuel supplier to the Ukrainian market, completely turned his shipment. Place of Belarusians was immediately taken by the owners of the resource from the EU – from Greece, Bulgaria, Romania and Lithuania.

But, as explained OilNews, it is a forced decision, one of the largest importers of fuel in Ukraine. And perhaps it is due to a long-standing problem of local authorities – their high level of corruption.

Belarusian producers and exporters of petroleum products since December 2015 are not carries out shipment of the fuel to Ukraine due to the actions of the Ukrainian customs officers in respect of the supply of the company “BNK-Ukraine”. Ban on export of the Republic of Tatarstan in Ukraine will act to resolve the conflict in court. About OilNews said importers of fuel.

The reason for stopping the supply of jet fuel resulted in the court decision intended to satisfy the requirements of GFS on accrual of increased excise duty by the transferred product from the category “fuel for jet engines” in group “special gasoline” in the subgroup “light distillates”. Thus, the importer is forced to pay a rate of 23 euros per tonne, and € 202 per ton (rates as at 2015). This makes the product uncompetitive in the market.

According to several decisions of the courts of the Zhytomyr posted in the unified state register, in February 2015 “BNK-Ukraine” the supply of RT production “Naftan”. From the next batch of fuel supplied under long-term contract, we took a sample and specialized laboratory of the SFS concluded that 90% of the product distils at a temperature of 209 degrees, the norm for light distillates at 210 degrees.

At the same time the control sample has been recognized laboratory “MASMA” conforming to the quality specification. A similar conclusion came and Lviv research Institute of judicial examinations. This allowed the court of first instance to acknowledge the requirements of the trader. However, Zhytomyr court of appeal in its decision of 1 February 2016 rejected the conclusions of “MASMA”, forensic science and newly recognized non-conformance. Thus, the return of fuel from Belarus to the Ukrainian market was postponed for an indefinite period. Now “BNK-Ukraine” will appeal against the decision in Higher adminsuda.

Note that the main criterion of distinction of the concepts of “light distillates and middle distillates” – the percentage of the volume of product which distils at a temperature of 210°C. If the temperature of 210° C is distilled 90% of the oil and more, this “light distillates”, if at this temperature, distilled under 90% of oil products, this “middle distillates”.

The first manipulation laboratories tax services in the field of research quality of jet fuel began in 2011 during the leadership of the customs service Igor Kaletnik and immediately identified the purpose of these innovations – extortion of bribes for the purpose of customs clearance of aviation fuel at a reduced rate of excise duty. According to suppliers, the unofficial rate is 8-10 euros per ton of imported volume. In addition, this product turned into white spirit, which later created problems with its further realization to consumers of the fuel.

In September 2015 such problems have arisen at suppliers of different fuel production. So, an independent examination of fuel grade Jet A-1 from Bulgaria, produced by an international surveyor SGS showed a content of aromatic hydrocarbons in the amount of 11-12%. At the same time, GFS lab has revealed 34% (normal 20%).

In 2015 half of the aviation kerosene market was filled by imports (only 113 thousand tons). On the Belarusian product had to 96.2 thousand tons (85%). In connection with the termination of the Belarusian import market shifted to more expensive sea supplies. Note that imports currently provided and the needs of the Armed forces of Ukraine.
