To exclude or replace a permanent member of the UN security Council, only by changing the Charter. This is possible if 2/3 of the members of the UN, including the 5 permanent members, will vote for change. It is difficult to do since the constant Slany of the Security Council have veto power. However, the Charter has a provision allowing you to make a decision without taking into account the vote of a permanent member, if the country he represents is a party to the conflict.
In addition to the end of 1991, the year of the permanent representative to the UN security Council was the Soviet Union. In December 1991, the year of the Russian Federation appealed to the UN Secretary General with a message which says that Russia is the legal successor of the USSR and will continue to work as a permanent member. H. P. de Cuellar, the then Secretary General, felt that the message is a notification character and does not require approval from the UN. It is clear that membership of the Russian Federation is based on the opinion of the Secretary General and endorsed by security Council permanent members. But in order to have a legal basis, had to appeal to the international Court and to request his opinion on the legality of this perfect de facto solution. If zainteresowania in this country now appeal to the international Court of justice (UN), and if the answer is no, opens the possibility to abolish the place of the Russian Federation in the composition of the security Council.

Rada called on the International community to recognize Russia as an aggressor guilty of the DNI and the occupation of the Crimea.Rada has appealed to the UN, the parliamentary assemblies of NATO and the GUAM, the European Parliament and national parliaments with a request for recognition of Russia as an aggressor country.
Additionally, 67 (over one third) of the UN member countries in favour to deprive of the right of veto of the permanent members of the security Council in cases when we are talking about the reaction to the conflict with a large number of victims.
