The state Duma has changed the rules of the cadastral assessment

The state Duma adopted in the second and third readings a bill on state cadastral evaluation, the correspondent “of Rosbalt”.

The bill proposes to change the order of the state cadastral estimation of objects of real estate which is currently being appraisers — physical persons who are members of one of the SRO of appraisers to be invited on a competitive basis by evaluation clients, that is, bodies of state power of constituent entities of the Russian Federation or bodies of local self-government.

According to the document, state cadastral valuation will be carried out by decision of the Executive body of state power of subject of the Russian Federation budgetary institution established by the Russian Federation. The list of properties to be evaluated, is formed by the bodies of Federal registration service on the basis of the decision on carrying out the state cadastral assessment, to the document. The frequency of assessment is not different from the current — not more than once every three years (in the Federal cities — not more often than once in two years) and at least once within five years. This provides for the possibility of the extraordinary assessment and the procedure for its conduct.

The bill provides for the stage of preparation for carrying out the state cadastral assessment, in which the budget institution is carried out, including collecting and processing information about the real property, the cadastral value of which was disputed.

Definition of cadastral cost is carried out prior to may 1 of the year following the year of preparation for carrying out the state cadastral assessment, and issued in the form of a report, the document says.

The results of determination of cadastral cost can be challenged before the appropriate Commission or in court. To appeal to the court preliminary appeal to the Board is not required.

The law will come into force on 1 January 2017. While 2020, established a transitional period during which the subjects of the Russian Federation decide to implement them cadastral valuation according to the new law or by the rules of the law on valuation activities in the Russian Federation.
